Buffalo, New York —The preliminary hearing for a lawsuit against the Elmwood Village Hotel proposal has been pushed back to August 10, 2006.

The hotel would require the demolition of at least five properties owned by Hans Mobius, 1109-1121 Elmwood and would cause the closure of several businesses. Already, two businesses, Skunk Tail Glass and Six Nations Native American Gift Shop have relocated, outside the Elmwood Strip. Don apparel, H.O.D. Tattoo and Mondo Video still remain on Elmwood; however, Mondo Video is planning on moving to a new location. The hotel will be 72 rooms and will cost at least 7 million dollars to build. Savarino Construction Services Corporation would be in charge of building the hotel and Wyndham Hotels would operate it.

Attorney Arthur Giacalone says that the court date was pushed back because “the court apparently felt it did not make sense to proceed with oral argument on 7/27 if Savarino is going to re-start the process.” Giacalone also stated that the decision to adjourn until August 10 “was not my idea.” On July 13, 2006 Savarino announced that they were withdrawing the proposal to “resubmit” it to “shed the lawsuits” against the proposal.

Savarino was allegedly supposed to resubmit the proposal by the end of last week but so far has not done so. The final meeting of Buffalo’s Common Council for the summer occurred today. The Council will not meet again until September.

“If they [Savarino] took no action today, re the hotel, [that is, accepting the new application, or rescinding the prior rezoning resolution], nothing official will happen for the next 6 weeks or so,” added Giacalone also saying that if this is the case, “the court may not be willing to hear oral argument on 8/10 since we will still be up in the air about what’s going on.” Giacalone also states that he is unsure about “what they [the Common Council] did today.”

Despite the call for a “do-over” of the proposals process, Giacalone still states that his client’s position of the “pending lawsuit will not be ‘moot’ or ‘academic’ unless and until the Common Council rescinds its prior vote(s) that approved the rezoning” for the buildings on Elmwood and one property on Forest Avenues.

Sam Savarino, CEO of Savarino Construction has been contacted, but has not replied to any e-mails. Area councilman Joseph Golombeck has also been e-mailed, but also has not replied.

The two crew-members of a US Army Apache helicopter which went down near Youssifiyah, Iraq are said by U.S. officials to be presumed dead after several failed searches for their bodies in the surrounding area.

A statement by army officials said yesterday that early reports suggested that the AH-64D Apache Longbow helicopter crashed at around 5:30pm local time on Saturday, near the town of Youssifiyah, located approximately 12 miles southwest of the Iraqi capital of Baghdad. The statement went on to say that the aircraft had been on “combat air patrol” at the time of the incident.

The statement, which was vague in its details, did not specify a definite crash site. Regarding current efforts to find the wreckage (and presumably the bodies), it was merely stated that “Two pilots are presumed dead, but recovery efforts continue following the crash.” The identities of the two victims are known; they are being withheld until their families are notified.

No other details regarding the crash were released, and the cause of the crash is unknown at the present time, but Youssifiyah has been the site of insurgency in the past. As of 3 p.m. GMT today, the US military have announced that they believe the aircraft was shot down.

As families fled their homes in the early morning hours on Thursday October 26, there was no warning. The Esperanza Fire southeast of Los Angeles and West of Palm Springs, California, had ballooned under the influence of Santa Ana winds to more than 19,000 acres as of the morning of October 27. No time to get the animals, no time for crates or even a leash. Sadly, owners left behind not only their horses, lamas, donkeys, chickens, rabbits, but also their dogs and cats.

Many of the families who did manage to evacuate their pets found themselves in the parking lot at the Fellowship in the Pass Church Red Cross Shelter where a MuttShack Animal Rescue team caught up with them.

Pam Anderson, Director of the emergency Red Cross shelter said that many people with animals had come and left.

The air was thick with smoke, and ash was raining down on the parking lot where dog owners, not able to take their dogs into the shelter were camping out in pup tents andin their cars.

Those who could afford it checked themselves into pet friendly hotels in nearby towns.

Some were prepared. Jane Garner, a small dog breeder was able to get all her animals out, and had set up her puppy runs alongside her RV in the parking lot. Others were not doing too well, having left home without as much as a leash.

The same scenario played out at the Red Cross shelter at Hemet High School. Animals were being boarded in vans, trailers and cars and small travel crates.

When MuttShack Animal Rescue arrived, a small fracas had sent several dogs off in different directions, running out of the school parking lot down busy streets necessitating an instant rescue response.

The Incident Command for the Esperanza Animals, Ramona Humane Society in San Jacinto welcomed MuttShack‘s offer to help at the shelters.

Ramona Humane Society had recently published a notice in their Newsletter about the newly passed “PETS Act”and warned owners not wait until a major disaster such as an earthquake or fireto prepare. “Be proactive to ensure that your pet will be taken care of.”

MuttShack and PetSmart Charities set up ad hoc facilities for the animals at both shelters.

The Red Cross shelter, run by Madison Burtchaell of the Orange County Red Cross was very accommodating about allowing a small emergency pet shelter adjacent to the School.

Barbara A. Fought of PetSmart Charities, an organization that works with animal welfare organizations and provide assistance in disasters, provided crates and emergency supplies.

MuttShack and Red Cross volunteers, Martin St. John, Tom Hamilton, and Steve Meissner helped assemble the crates to secure a safe environment for evacuated pets.

It was a great relief for evacuees who had camped out in the parking lot to finally leave their vehicles and relax at the shelter, setting up their cots to grab some sorely needed rest.

Firefighters and residents reported loss of wildlife and animals. The Esperanza fire burned 34 homes, consumed 40,000 acres and cost five Firefighters their lives before it was contained four days later on October 30. Firefighting operations cost nearly $10 million.

1. A $250k donation, earmarked for hardware. I would appreciate knowing who made the donation, when, and (if possible) why. I’d love to know if the WMF has determined how this donation will be used.

The 250K is coming from a recently-established private foundation that has educational goals similar to ours: they admire what we’re doing and want to support us, so they phoned the office and offered to make a contribution. (I’m not sure if it matters for your story, but the 250K is actually unrelated to the online fundraiser, and is not included in the fundraiser totals. Also, it may be worth noting that we have not received the money yet. This is totally fine: these things always take a while.)

After that call, I consulted with the tech team, and we decided to use the money to buy core database servers in our Florida cluster. We had intended to buy the servers anyway: this donation will simply cover most/all of the cost. I am happy to tell you the basic story, but I don’t want to publicly give the name of the organization that’s offering us the money: I don’t have their permission to do that. They might be fine with it: who knows. I just am not comfortable making that decision for them.

2. A $500k donation. I would appreciate knowing who made the donation, when, and (if possible) why. I’d also like to know if there were any restrictions placed on this donation, like the previous one was dedicated to hardware purchases.You may already know that our default position is to give donors anonymity unless they specifically say it’s okay to use their names. Lots of donors, particularly those who are giving large amounts, prefer to remain anonymous, and I think it’s only fair to respect that. In this instance, I don’t have permission to give the donor’s name: sorry.

I do not know specifically why this donor made the contribution: clearly they wanted to support our work, but I don’t know anything more specific than that. And no, there were no restrictions put on the donation.

3. A presentation was made to Sun Microsystems by yourselves, plus Roger McNamee in December. This presentation was at least partially created on November 20th and 21st, and has a large amount of information in it regarding recent past, present, and near-term financial, technical, and traffic. I have at least several questions regarding this presentation, including:3.a When did the meeting with Sun Microsystems take place, and with whom did you meet?3.b Assuming the donations proposals are eventually worked out and all parties are able to reach agreement, will the WMF move to a proprietary server network?3.c One of the technical advances discussed in the proposal is collaborative video. Researching this I discovered a mediawiki site within Kaltura which seemed to be very closely related. Is this connection correct?

In general, I don’t want to have a conversation with the media (even friendly media!) about meetings we have with other organizations, until and unless there is something worth talking about. We have lots of provisional conversations with lots of different organizations and people, which don’t necessarily imply anything about future plans or possibilities. So as a general practice, I would never comment on a specific meeting or presentation.

Beyond that, as I’m sure you know, the Wikimedia Foundation is committed to running on an infrastructure powered by open source and open standards. We have no plans to change that.

Wikinews reporter Iain Macdonald has performed an interview with Dr Isabella Margara, a London-based member of the Communist Party of Greece (KKE). In the interview Margara sets out the communist response to current events in Greece as well as discussing the viability of a communist economy for the nation. She also hit back at Petros Tzomakas, a member of another Greek far-left party which criticised KKE in a previous interview.

The interview comes amid tensions in cash-strapped Greece, where the government is introducing controversial austerity measures to try to ease the nation’s debt-problem. An international rescue package has been prepared by European Union member states and the International Monetary Fund – should Greece require a bailout; protests have been held against government attempts to manage the economic situation.

Over the past week, diplomatic actions have averted — or, at least delayed — military strikes on Syria by the United States. Wikinews sought input from a range of international experts on the situation; and, the tensions caused by Russia’s support for the al-Assad regime despite its apparent use of chemical weapons.

Tensions in the country increased dramatically, late August when it was reported between 100 and 1,300 people were killed in an alleged chemical attack. Many of those killed appeared to be children, with some of the pictures and video coming out of the country showing — according to witnesses — those who died from apparent suffocation; some foaming at the mouth, others having convulsions.

Amongst Syria’s few remaining allies, Iran, China, and Russia continue to oppose calls for military intervention. In an effort to provide a better-understanding of the reasoning behind their ongoing support, the following people were posed a range of questions.

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.
