Nokia appoints Microsoft Business Division Head as chief executive

Sunday, September 12, 2010

The Finnish communications corporation Nokia announced that its Head will change on September 21. The previous chief executive Olli-Pekka Kallasvuo will continue to chair in non-executive capacity. The head of Microsoft Business division Stephen Elop will take the position. It is the first time a non-Finn becomes Nokia president and chief executive.

The change follows Nokia’s fall in world markets. It includes a decrease in Nokia’s American market share to less than ten percent after failed negotiations with a number of leading American phone providers. An analyst at a market analyst company Canalys, Pete Cunningham, said, “Despite holding 38 percent market share of the smartphone market, Nokia’s failure to compete with the iPhone and high-tier Android devices, combined with its lack of progress in gaining significant traction in the United States, has led to press and investor dissatisfaction.”

Some commenters suggested that Nokia chose Mr. Elop partly because he is a Canadian, following criticism of American candidates by the Finnish press. However a Nokia spokesman rejected this, saying, “Nationality was not a selection criteria.”

Stephen Elop was president and CEO of the graphics and web-development software house Macromedia prior to its acquisition by Adobe in 2005. He then joined Microsoft as President of Microsoft’s Business Division in January, 2008. Commenting on his new role he said, “Nokia has a unique global position as well as a great brand upon which we can build. The Nokia slogan clearly states our key mission: Connecting People, which will acquire new dimensions as we build our portfolio of products, solutions and services.”

In the announcement the Chairman of the Nokia Board of Directors Jorma Ollila stressed an expected shift of focus from hardware to software. “His [Stephen Elop’s] strong software background and proven record in change management will be valuable assets as we press harder to complete the transformation of the company. We believe that Stephen will be able to drive both innovation and efficient execution of the company strategy in order to deliver increased value to our shareholders”.

Nokia stated in an official blog post, “Nokia is transitioning from a hardware manufacturer of mobile devices to a software and solutions business. …Stephen’s background in the software industry is one of his key strengths.”

A district court in Berlin has issued a preliminary injunction against the Wikimedia Foundation for displaying the true name of a computer hacker on the German Wikipedia. The family of the deceased German hacker, known as “Tron,” obtained the provisional order in Berlin on December 14. The order was corrected on December 19 because it was at first addressed to Saint Petersburg, Russia instead of Saint Petersburg, Florida.

Tron became famous as the first person to crack the encryption of Pay TV and calling cards. He died in 1998, at the age of 26, in an apparent suicide. Questions have arisen as to the nature of the hacker’s death.

The court has ordered the German Wikipedia to remove all forms of the hacker’s complete civil name “Boris Floricic”. The court states that this is justified by the fact that the hacker never worked under his civil name, but instead his Internet alias.

The legality of the order is in question, because the Wikimedia Foundation servers are not located in Germany, but instead in the United States. Whether the Foundation will comply or if the family’s attorneys have any means to enforce the decision remains in doubt. The case prompted many German media outlets to publicly display the hacker’s real name.

On January 17 the same court also issued a preliminary injunction against Wikimedia Deutschland e.V., the German chapter of the Wikimedia Foundation, citing the same reasons. In that injuction, the chapter was ordered to cease redirecting www.wikipedia.de to de.wikipedia.org. Wikimedia Deutschland complied, but its lawyers announced that they will appeal the decision, saying that Tron’s civil name has long since been public knowledge.

Disney buys Pixar

Disney buys Pixar

Tuesday, January 24, 2006

The Walt Disney Company has finalized a US$7.4 billion deal to acquire its long-time partner Pixar in an all stock buy-out. The deal will make Steve Jobs, current Pixar and Apple CEO, Disney’s largest shareholder with about 7% (valued at over $3.5 billion) and a member of the board of directors.

The merger was speculated all day Tuesday on the stock market and the announcement came just after trading closed for the day. Terms of the merger include Pixar’s John Lasseter becoming Disney’s new chief creative officer in charge of animation at the combined Disney-Pixar Animation Studios, as well as principal creative advisor at Walt Disney Imagineering, the unit of the company responsible for research and development of Disney theme parks worldwide.

Jobs purchased what became Pixar for $10 million in 1986 from George Lucas’s computer animation division at Lucasfilm. Toy Story, its first feature film, came a decade later, and began a long string of animation hits, including Finding Nemo. Such successes proved to be increasingly elusive for Disney to manage on its own. The partnership between the two studios had become shaky in recent years, as former Disney head Michael Eisner clashed with Jobs over the renewal terms of their agreement. In 2003, prior to his dismissal from Disney, Eisner infuriated Pixar’s creative team by predicting Finding Nemo would be a failure. Steve Jobs broke off negotiations in January 2004, having told one executive previously, “I don’t see how the relationship can continue as long as Eisner is there.”

Lost Something On Your Computer? It May Not Be As Bad As You Think

Posted on Thursday, March 25, 2021 in Business Energy Advice

By Jim Grayson

Just because you can’t see it, or can’t find it doesn’t mean that its not there! I would say at least 90% of people who use a computer on a regular basis have no idea how it actually works. They think that things like icons on their desktop will make their computer run slow. Many things that because they have a slow computer it will cause their Internet to be slow. Others think that “Windows” is the computer and they dont realize that its just another piece of software like every other program running on a computer. Finally many people think that when they click and delete something off of their computer, and wipe it from their trash bin that the information is actually gone. If you think that is the case, and you think you have lost your information for good, think again, cause you might just be in luck!

When information is stored on your hard drive or hard disk, it is stored in things called sectors. When you delete something off of your computer through Windows or Linux or Dos all it is doing is telling the computer that those sectors are now available to be written over. The computer doesnt actually wipe them clean, which would be useless when it could just as easily write over them. So if you have a virus or a computer illiterate roommate that happens to delete the important files off your computer, then you might just be able to get that information back. There is one catch, its not easy!

Not only is it not easy, but also 99% of people dont have the technology, know-how or resources and education to do it themselves. This is why there are professional companies that specialize in data recovery, and believe me, they charge tons of money.

Data loss occurring from an actual hard drive failure such as overheating and melting important sensors or an electric shock that fries components might actually result in permanent data loss. Yep, so sometimes data recovery cannot restore lost files. This is why data security is a smart, preventative measure. Backing up data on multiple hard drives and CDs and DVDs and on multiple computers will prevent disastrous things like permanent data loss from occurring. Be smart back your files up, it will cost you less to back up on hard drives than it will cost you to recover files directly from your hard disk.

Thursday, February 17, 2005

CARACAS, Venezuela —The Brazilian President Luiz Inácio Lula da Silva met the Venezuelan President Hugo Chavez on February 14, 2005 in Caracas, Venezuela. Brazil and Venezuela signed agreements of cooperation on many areas. According to the Brazilian government this was a strategical encounteur. This meeting is the first of three meetings that President Lula will have with South American Presidents in three days. The scheduled meetings are with the presidents of: Venezuela (February, 14), Guiana (February, 15) and Suriname (February, 16).

President Lula was accompanied by the following comitiva: the Minister of Development, Industry, and External Trade Luiz Fernando Furlan, the Minister of Finance Antônio Palocci, the Minister of Foreign Relations Celso Amorim, the Minister of Health Humberto Costa, the Minister of Mines and Energy Dilma Roussef, the Minister of Tourism Walfrido Mares Guia, the President of Petrobras José Eduardo Dutra, the President of National Economic and Social Development Bank (BNDES) Guido Mantega, the President of Eletrobrás Silas Rondeau Cavalcante Silva and the Special Secretary for Aquaculture and Fisheries José Fritsch. In addition a delegation of executives representing enterprises from Brazil accompanied the President.

The Brazilian Ministry of External Relations told the trip aims the construction of a strategical alliance and commercial integration between both countries. The Brazilian Presidential Advisor Marco Aurélio Garcia said:”With this gesture, Brazil will consolidate one of its major political goals, which is the constitution of a South American community of nations”. He added: “These agreements with Venezuela are strategical. We want this agreement as a model for other agreements in the region.”

According to President Lula the integration of the Latin America is the priority number one of his government. Days before the arrival in Venezuela and commenting about the trip Lula said: “We’re going to do the same thing in Colombia and in other countries in which integration is no longer a campaign speech but part of the way we deal with real things, day to day”.

The integration of the Latin America is the politics repeatedly proposed by Lula during the meetings of the Foro de São Paulo. According to him and the others members of the Foro there must be a integration among all the left parties and governments of Latin America. The union aims to be an alternative and opposing force to the politics and influence of the richest countries, mainly the United States. Among the organizations which are usually participants of the Foro de São Paulo are: Communist Party of Cuba, Colombian Communist Party, Communist Party of Bolivia, Communist Party of Brazil, Workers’ Party, Paraguayan Communist Party, Peruvian Communist Party, Socialist Party of Peru, National Liberation Army, Revolutionary Armed Forces of Colombia, Farabundo Martí National Liberation Front, Guatemalan National Revolutionary Unity, Tupamaros.

On December 4, 2001 during the 10th edition of the Foro de São Paulo in Havana Lula said:”A shoal of small fish may mean the finishing of the hungry in our countries, in out continent. We should not think as the History ended on our journey by the Earth. Even it happens just once, or with one gesture, let’s effectively contribute to the improve the life of millions of human beings who live socially excluded by this neoliberal model.”[1]

In Venezuela, once again, he brought out the integration wish: “This is the biggest dream I am carrying, that we can negotiate collectively, not like one country, but like a set of countries so we can do that our people may have the chance to conquer the full citizenship.”

Security tightened at Singapore courts after two attempts to escape

Security tightened at Singapore courts after two attempts to escape
Posted on Wednesday, March 17, 2021 in Uncategorized

Friday, June 13, 2008

Following a failed escape attempt on Wednesday at the detention facilities of the Subordinate Courts of Singapore, security has been increased.

At 1:45 a.m., Jamaluddin Salam, 32, and Salman Abu Samah, 28, tried to escape from the basement lock-up by requesting water. An officer opened the cell gate to fulfill the request, which is a breach of procedure; he should have merely passed water through a hole in the cell door. The prisoners took advantage of the open gate and overpowered the officer, violently punching and kicking him to the ground before heading to the gates at the lock-up’s exit, pressing a buzzer to inform the officer at the control room to unlock the gates. The officer did not check the security camera monitor to see who was at the gates before unlocking it, constituting another breach of procedure.

Following their successful exit from the lock-up, the duo used the lift just past the exit gates to reach the fourth floor of the facility, forcing open a locked door and going down a stairwell to reach the ground floor.

Within 10 minutes of the escape, the duo was spotted at the ground floor. The alarm was raised and officers were deployed to seal off all exits. Near the facility’s main entrance, Salman tripped and was quickly subdued. Jamaluddin made his way to the back entrance, but found it locked. He then doubled back to the front and dashed out of the facility. An officer tripped him with his baton about 100m outside of the facility.

The attempted escape came barely four months after terrorist-fugitive Mas Selamat Kastari fled the Whitley Road Detention Centre. Failure to observe procedures on the part of his minders was also a reason for that escape.

The two men were brought from Queenstown Remand Prison to the Subordinate Courts for bail purposes. Jamaluddin was facing six counts of robbery with hurt and drug charges, while Salman had three charges of robbery with hurt. Both cases are unrelated. Bail was set at $30,000 for Jamaluddin and $20,000 for Salman.

Police revealed yesterday that Jamaluddin and Salman were not the only inmates in the cell. It has not been revealed how many inmates were in the cell but it is known that they stayed put during the escape attempt.

In a statement, police said they have been upgrading the lock-up area since 2003, adding extra security grilles and enhancing the CCTV system.

A security audit of all lock-ups was conducted in March. The following month, a working group was set-up to look specifically into the security of the Subordinate Courts lock-up facilities.

The Criminal Investigation Department (CID) is now investigating the circumstances of the attempted escape to see if any officers were negligent.

Due to the escape attempt, security at the facility has been tightened to prevent a similar incident from happening. New security measures include an extra lock fixed onto the lock-up exit gates so that another officer will need to check who is leaving the area when it is unlocked. The elevator has also been secured and can only be activated with a key.

Jamaluddian and Salman are now likely to face a barrage of charges including vandalism, police battery and escaping from legal custody.

Health Advantages of Kombucha Tea as the Trend Grows

by

angiehill

Have you seen the most recent adoption of kombucha in the past few months. It’s getting a lot of momentum from the general public, especially when celebrities like Barbara Streisand, and Halle Berry, are seen toting a bottle of kombucha while they’re on a shopping spree in New York, Dubai or Las Vegas.

Kombucha wasn’t always popular like it is these days. Sure, it’s now becoming the sensational thing to chug to be cool, but there was an era, before it was produced by big names and stocked at your local health food store. There never were 8 different brands and brews to choose from. I recently counted 10 different versions at my neighborhood Whole Foods. Of all these kombucha drinks, I have to say that my favorite, store-bought brand, is by far the GTC’s Synergy batch. Their GingerBerry is to live for! I’ve tasted almost every version on the market, or at least every kind I’ve ever seen. Additionally, I’m a fan of ginger ale of any variety, except the Schweppes brand. That junk is nothing more than cola in my professional opinion. Give me a real-deal ginger brew anytime! That being said, you simply must experience the GingerBerry from GTC. When my Mother started making and enjoying her own kombucha, it was in the late 70’s and she has had the same culture the entire time. Several years later, when I was just a child, it seemed bazaar and sometimes humiliating to have my peers see a gallon jar standing in the kitchen. It looked like a science class. That large, gallon jar fermenting a dark juice. As a youngster, I’ve even mistaken kombucha for cold ice tea in the fridge as she always kept her kombucha tea in a fancy glass pouring-pitcher. As a 13 year-old, after working up a sweat, playing in the neighborhood, I’d head inside with a peer needing to be re-hydrated. Reaching a few huge chugs of kombucha tea when your mouth were expecting iced tea can really catch you off guard. Now I should tell you that my house never, ever stocked Gatorade or Sprite, etc. Rather, on demand, we stocked plenty of orange juice from concentrate, always mixed, and the other option was H2O, unsweetened tea or kombucha. Cool people drink it because it’s yummy. And so do you. While famous people make a lot of dough and can easily afford the $4 per bottle that it costs here in Seattle. Me, I’d prefer to make it in my home in small batches, for a mere fraction of the cost. And for a newby, there are endless websites that distribute free instructions for brewing this truly amazing tonic. Most of us average people sip on kombucha for it’s health advantages. The list of healthy stories is extremely long and includes things like aiding digestion, increasing immune system response, strengthening the body’s blood system, reversing depression, spiking mental awareness, and the list is ongoing. I prefer to drink it for the clarity of thought it provides for me. I’ve even replaced my morning cup of coffee with a travel-mug of chilled, semi-sweetened kombucha tea. If you prefer feeling great, I suggest trying this ‘wonder drink.’ Afterall, it can’t hurt. But remember that if you suffer from life threatening illness, you should always talk to a health care provider. And let him or her know that you’re drinking kombucha. Find out what he or she say about it. So, don’t forget that you need not be a heart-throb with mega-money to thoroughly enjoy kombucha. All you need are some simple supplies, a fair amount of desire, and a scoby. You also can maintain a limitless stock of kombucha tea. Here is a breakdown of exactly what you’ll need to drink like a star. Stainless steel, glass or lead-free ceramic pot (such as Corningware) to boil water Glass jar to accommodate the amount of Kombucha you want to make Metal or wood long handled spoon for stirring Measuring cup Porous cloth, paper towel or paper coffee filter Tea Kombucha scoby

Sandra Fluke nominated by Time magazine for Person of the Year

Sandra Fluke nominated by Time magazine for Person of the Year

Friday, November 30, 2012

Women’s rights advocate and Georgetown University Law Center graduate Sandra Fluke has been named as a candidate by Time magazine for their Person of the Year.

Sandra Fluke was the focus of media in February after attempting to testify before a Republican-controlled committee in the United States House of Representatives about contraception and women’s health. Kate Pickert of Time wrote in her profile, “Fluke … weathered the attention with poise and maturity and emerged as a political celebrity.”

Fluke … weathered the attention with poise and maturity and emerged as a political celebrity.

Time concluded Fluke helped give U.S. President Barack Obama an edge in his presidential re-election campaign: “Democrats gave her a national-convention speaking slot as part of their push to make reproductive rights a central issue in the 2012 presidential campaign — one that helped Barack Obama trounce Mitt Romney among single women on Election Day.”

Honored to be listed for Time’s Person of Year.

Fluke responded to the nomination via Twitter, and stated she was “Honored to be listed for Time’s Person of Year”. In the same statement she also drew attention to the scarcity of women on the list of candidates.

An analysis of Fluke’s candidacy by Peter Roff of U.S. News & World Report called attention to her role in the political phenomenon in the recent election cycle known as the “War on Women” which drew significant attention to issues of women’s rights. Roff gave advice to the Republican party on the way it relates to women, “Once the Republicans become comfortable talking about all issues as though they were women’s issues too — issues like unemployment, economic growth, job creation, education, and healthcare as well as the so-called social issues — they will be demonstrating that women have a home in the GOP. Until they do however it will be the Sandra Flukes of the world that continue to carry the day when it counts.”

Journalist Leslie Marshall observed some conservative political commentators were critical of Time for its nomination of Fluke for Person of the Year.

… she showed true strength over adversity. And she has since become a women’s health activist. For these reasons alone, she belongs on this list.

Marshall argued Fluke belongs on the list: “She should be credited with reminding women on both the right and the left; that many of us agree on the issue of women’s reproductive rights. Although some of us might be Democrats and some Republicans, our gender unites us. She brought more women to the polls, reminding us of the decades it took to be where we are and what was at stake for women if we did not re-elect President Obama. In speaking at the Democratic National Convention, she showed true strength over adversity. And she has since become a women’s health activist. For these reasons alone, she belongs on this list.”

However, Marshall stated she wouldn’t be voting for Fluke’s candidacy, but would instead cast her ballot for Malala Yousafzai, a 15-year-old female education activist who survived a Taliban assassination attempt.

Fluke was a featured speaker on September 5 at the 2012 Democratic National Convention in Charlotte, North Carolina. Fluke spoke to attendees at the convention about the consequences for women of electing Republican candidate for U.S. President, Mitt Romney, over incumbent President Barack Obama. Fluke has campaigned with President Obama in his bid for re-election.

She was recognized April 22 with the Stand Up for Choice Award. Fluke was given the Stand Up for Choice Award at the “Third Annual Multi-Generational Brunch” of the organization NARAL Pro-Choice America which was held in New York City (NYC), New York in the United States.

Fluke received a nomination in March as a candidate for Time magazine’s 100 most influential people in the world. The list is released annually as a special edition of Time magazine, titled Time 100.

She gave testimony to the US Congress on February 23 before the House Democratic Steering and Policy Committee at a hearing about women’s health and contraception. She also worked for Sanctuary for Families in NYC which worked to crack down on human trafficking and domestic violence.

Plane crashes into office block in Austin, Texas/suicide note

Plane crashes into office block in Austin, Texas/suicide note
Posted on Wednesday, March 10, 2021 in Uncategorized

This is the online suicide letter authored by Andrew Stack, the man believed to be responsible for flying a light aircraft into a building in Austin, Texas. It was originally posted at Stack’s site, http://embeddedart.com/. The hosting company, T35, took the site offline per an FBI request. The note is reproduced here in its entirety.

If you’re reading this, you’re no doubt asking yourself, “Why did this have to happen?” The simple truth is that it is complicated and has been coming for a long time. The writing process, started many months ago, was intended to be therapy in the face of the looming realization that there isn’t enough therapy in the world that can fix what is really broken. Needless to say, this rant could fill volumes with example after example if I would let it. I find the process of writing it frustrating, tedious, and probably pointless… especially given my gross inability to gracefully articulate my thoughts in light of the storm raging in my head. Exactly what is therapeutic about that I’m not sure, but desperate times call for desperate measures.

We are all taught as children that without laws there would be no society, only anarchy. Sadly, starting at early ages we in this country have been brainwashed to believe that, in return for our dedication and service, our government stands for justice for all. We are further brainwashed to believe that there is freedom in this place, and that we should be ready to lay our lives down for the noble principals represented by its founding fathers. Remember? One of these was “no taxation without representation”. I have spent the total years of my adulthood unlearning that crap from only a few years of my childhood. These days anyone who really stands up for that principal is promptly labeled a “crackpot”, traitor and worse.

While very few working people would say they haven’t had their fair share of taxes (as can I), in my lifetime I can say with a great degree of certainty that there has never been a politician cast a vote on any matter with the likes of me or my interests in mind. Nor, for that matter, are they the least bit interested in me or anything I have to say.

Why is it that a handful of thugs and plunderers can commit unthinkable atrocities (and in the case of the GM executives, for scores of years) and when it’s time for their gravy train to crash under the weight of their gluttony and overwhelming stupidity, the force of the full federal government has no difficulty coming to their aid within days if not hours? Yet at the same time, the joke we call the American medical system, including the drug and insurance companies, are murdering tens of thousands of people a year and stealing from the corpses and victims they cripple, and this country’s leaders don’t see this as important as bailing out a few of their vile, rich cronies. Yet, the political “representatives” (thieves, liars, and self-serving scumbags is far more accurate) have endless time to sit around for year after year and debate the state of the “terrible health care problem”. It’s clear they see no crisis as long as the dead people don’t get in the way of their corporate profits rolling in.

And justice? You’ve got to be kidding!

How can any rational individual explain that white elephant conundrum in the middle of our tax system and, indeed, our entire legal system? Here we have a system that is, by far, too complicated for the brightest of the master scholars to understand. Yet, it mercilessly “holds accountable” its victims, claiming that they’re responsible for fully complying with laws not even the experts understand. The law “requires” a signature on the bottom of a tax filing; yet no one can say truthfully that they understand what they are signing; if that’s not “duress” than [sic] what is. If this is not the measure of a totalitarian regime, nothing is.

How did I get here?

My introduction to the real American nightmare starts back in the early ‘80s. Unfortunately after more than 16 years of school, somewhere along the line I picked up the absurd, pompous notion that I could read and understand plain English. Some friends introduced me to a group of people who were having ‘tax code’ readings and discussions. In particular, zeroed in on a section relating to the wonderful “exemptions” that make institutions like the vulgar, corrupt Catholic Church so incredibly wealthy. We carefully studied the law (with the help of some of the “best”, high-paid, experienced tax lawyers in the business), and then began to do exactly what the “big boys” were doing (except that we weren’t steeling [sic] from our congregation or lying to the government about our massive profits in the name of God). We took a great deal of care to make it all visible, following all of the rules, exactly the way the law said it was to be done.

The intent of this exercise and our efforts was to bring about a much-needed re-evaluation of the laws that allow the monsters of organized religion to make such a mockery of people who earn an honest living. However, this is where I learned that there are two “interpretations” for every law; one for the very rich, and one for the rest of us… Oh, and the monsters are the very ones making and enforcing the laws; the inquisition is still alive and well today in this country.

That little lesson in patriotism cost me $40,000+, 10 years of my life, and set my retirement plans back to 0. It made me realize for the first time that I live in a country with an ideology that is based on a total and complete lie. It also made me realize, not only how naive I had been, but also the incredible stupidity of the American public; that they buy, hook, line, and sinker, the crap about their “freedom”… and that they continue to do so with eyes closed in the face of overwhelming evidence and all that keeps happening in front of them.

Before even having to make a shaky recovery from the sting of the first lesson on what justice really means in this country (around 1984 after making my way through engineering school and still another five years of “paying my dues”), I felt I finally had to take a chance of launching my dream of becoming an independent engineer.

On the subjects of engineers and dreams of independence, I should digress somewhat to say that I’m sure that I inherited the fascination for creative problem solving from my father. I realized this at a very young age.

The significance of independence, however, came much later during my early years of college; at the age of 18 or 19 when I was living on my own as student in an apartment in Harrisburg, Pennsylvania. My neighbor was an elderly retired woman (80+ seemed ancient to me at that age) who was the widowed wife of a retired steel worker. Her husband had worked all his life in the steel mills of central Pennsylvania with promises from big business and the union that, for his 30 years of service, he would have a pension and medical care to look forward to in his retirement. Instead he was one of the thousands who got nothing because the incompetent mill management and corrupt union (not to mention the government) raided their pension funds and stole their retirement. All she had was social security to live on.

In retrospect, the situation was laughable because here I was living on peanut butter and bread (or Ritz crackers when I could afford to splurge) for months at a time. When I got to know this poor figure and heard her story I felt worse for her plight than for my own (I, after all, I thought I had everything to in front of me). I was genuinely appalled at one point, as we exchanged stories and commiserated with each other over our situations, when she in her grandmotherly fashion tried to convince me that I would be “healthier” eating cat food (like her) rather than trying to get all my substance from peanut butter and bread. I couldn’t quite go there, but the impression was made. I decided that I didn’t trust big business to take care of me, and that I would take responsibility for my own future and myself.

Return to the early ‘80s, and here I was off to a terrifying start as a ‘wet-behind-the-ears’ contract software engineer… and two years later, thanks to the fine backroom, midnight effort by the sleazy executives of Arthur Andersen (the very same folks who later brought us Enron and other such calamities) and an equally sleazy New York Senator (Patrick Moynihan), we saw the passage of 1986 tax reform act with its section 1706.

For you who are unfamiliar, here is the core text of the IRS Section 1706, defining the treatment of workers (such as contract engineers) for tax purposes. Visit this link for a conference committee report (http://www.synergistech.com/1706.shtml#ConferenceCommitteeReport) regarding the intended interpretation of Section 1706 and the relevant parts of Section 530, as amended. For information on how these laws affect technical services workers and their clients, read our discussion here (http://www.synergistech.com/ic-taxlaw.shtml).

SEC. 1706. TREATMENT OF CERTAIN TECHNICAL PERSONNEL.

(a) IN GENERAL – Section 530 of the Revenue Act of 1978 is amended by adding at the end thereof the following new subsection:

(d) EXCEPTION. – This section shall not apply in the case of an individual who pursuant to an arrangement between the taxpayer and another person, provides services for such other person as an engineer, designer, drafter, computer programmer, systems analyst, or other similarly skilled worker engaged in a similar line of work.

(b) EFFECTIVE DATE. – The amendment made by this section shall apply to remuneration paid and services rendered after December 31, 1986.

Note:

· “another person” is the client in the traditional job-shop relationship.

· “taxpayer” is the recruiter, broker, agency, or job shop.

· “individual”, “employee”, or “worker” is you.

Admittedly, you need to read the treatment to understand what it is saying but it’s not very complicated. The bottom line is that they may as well have put my name right in the text of section (d). Moreover, they could only have been more blunt if they would have came out and directly declared me a criminal and non-citizen slave. Twenty years later, I still can’t believe my eyes.

During 1987, I spent close to $5000 of my ‘pocket change’, and at least 1000 hours of my time writing, printing, and mailing to any senator, congressman, governor, or slug that might listen; none did, and they universally treated me as if I was wasting their time. I spent countless hours on the L.A. freeways driving to meetings and any and all of the disorganized professional groups who were attempting to mount a campaign against this atrocity. This, only to discover that our efforts were being easily derailed by a few moles from the brokers who were just beginning to enjoy the windfall from the new declaration of their “freedom”. Oh, and don’t forget, for all of the time I was spending on this, I was loosing income that I couldn’t bill clients.

After months of struggling it had clearly gotten to be a futile exercise. The best we could get for all of our trouble is a pronouncement from an IRS mouthpiece that they weren’t going to enforce that provision (read harass engineers and scientists). This immediately proved to be a lie, and the mere existence of the regulation began to have its impact on my bottom line; this, of course, was the intended effect.

Again, rewind my retirement plans back to 0 and shift them into idle. If I had any sense, I clearly should have left abandoned engineering and never looked back.

Instead I got busy working 100-hour workweeks. Then came the L.A. depression of the early 1990s. Our leaders decided that they didn’t need the all of those extra Air Force bases they had in Southern California, so they were closed; just like that. The result was economic devastation in the region that rivaled the widely publicized Texas S&L fiasco. However, because the government caused it, no one gave a shit about all of the young families who lost their homes or street after street of boarded up houses abandoned to the wealthy loan companies who received government funds to “shore up” their windfall. Again, I lost my retirement.

Years later, after weathering a divorce and the constant struggle trying to build some momentum with my business, I find myself once again beginning to finally pick up some speed. Then came the .COM bust and the 911 nightmare. Our leaders decided that all aircraft were grounded for what seemed like an eternity; and long after that, ‘special’ facilities like San Francisco were on security alert for months. This made access to my customers prohibitively expensive. Ironically, after what they had done the Government came to the aid of the airlines with billions of our tax dollars … as usual they left me to rot and die while they bailed out their rich, incompetent cronies WITH MY MONEY! After these events, there went my business but not quite yet all of my retirement and savings.

By this time, I’m thinking that it might be good for a change. Bye to California, I’ll try Austin for a while. So I moved, only to find out that this is a place with a highly inflated sense of self-importance and where damn little real engineering work is done. I’ve never experienced such a hard time finding work. The rates are 1/3 of what I was earning before the crash, because pay rates here are fixed by the three or four large companies in the area who are in collusion to drive down prices and wages… and this happens because the justice department is all on the take and doesn’t give a fuck about serving anyone or anything but themselves and their rich buddies.

To survive, I was forced to cannibalize my savings and retirement, the last of which was a small IRA. This came in a year with mammoth expenses and not a single dollar of income. I filed no return that year thinking that because I didn’t have any income there was no need. The sleazy government decided that they disagreed. But they didn’t notify me in time for me to launch a legal objection so when I attempted to get a protest filed with the court I was told I was no longer entitled to due process because the time to file ran out. Bend over for another $10,000 helping of justice.

So now we come to the present. After my experience with the CPA world, following the business crash I swore that I’d never enter another accountant’s office again. But here I am with a new marriage and a boatload of undocumented income, not to mention an expensive new business asset, a piano, which I had no idea how to handle. After considerable thought I decided that it would be irresponsible NOT to get professional help; a very big mistake.

When we received the forms back I was very optimistic that they were in order. I had taken all of the years information to Bill Ross, and he came back with results very similar to what I was expecting. Except that he had neglected to include the contents of Sheryl’s unreported income; $12,700 worth of it. To make matters worse, Ross knew all along this was missing and I didn’t have a clue until he pointed it out in the middle of the audit. By that time it had become brutally evident that he was representing himself and not me.

This left me stuck in the middle of this disaster trying to defend transactions that have no relationship to anything tax-related (at least the tax-related transactions were poorly documented). Things I never knew anything about and things my wife had no clue would ever matter to anyone. The end result is… well, just look around.

I remember reading about the stock market crash before the “great” depression and how there were wealthy bankers and businessmen jumping out of windows when they realized they screwed up and lost everything. Isn’t it ironic how far we’ve come in 60 years in this country that they now know how to fix that little economic problem; they just steal from the middle class (who doesn’t have any say in it, elections are a joke) to cover their asses and it’s “business-as-usual”. Now when the wealthy fuck up, the poor get to die for the mistakes… isn’t that a clever, tidy solution.

As government agencies go, the FAA is often justifiably referred to as a tombstone agency, though they are hardly alone. The recent presidential puppet GW Bush and his cronies in their eight years certainly reinforced for all of us that this criticism rings equally true for all of the government. Nothing changes unless there is a body count (unless it is in the interest of the wealthy sows at the government trough). In a government full of hypocrites from top to bottom, life is as cheap as their lies and their self-serving laws.

I know I’m hardly the first one to decide I have had all I can stand. It has always been a myth that people have stopped dying for their freedom in this country, and it isn’t limited to the blacks, and poor immigrants. I know there have been countless before me and there are sure to be as many after. But I also know that by not adding my body to the count, I insure nothing will change. I choose to not keep looking over my shoulder at “big brother” while he strips my carcass, I choose not to ignore what is going on all around me, I choose not to pretend that business as usual won’t continue; I have just had enough.

I can only hope that the numbers quickly get too big to be white washed and ignored that the American zombies wake up and revolt; it will take nothing less. I would only hope that by striking a nerve that stimulates the inevitable double standard, knee-jerk government reaction that results in more stupid draconian restrictions people wake up and begin to see the pompous political thugs and their mindless minions for what they are. Sadly, though I spent my entire life trying to believe it wasn’t so, but violence not only is the answer, it is the only answer. The cruel joke is that the really big chunks of shit at the top have known this all along and have been laughing, at and using this awareness against, fools like me all along.

I saw it written once that the definition of insanity is repeating the same process over and over and expecting the outcome to suddenly be different. I am finally ready to stop this insanity. Well, Mr. Big Brother IRS man, let’s try something different; take my pound of flesh and sleep well.

The communist creed: From each according to his ability, to each according to his need.

The capitalist creed: From each according to his gullibility, to each according to his greed.
